Revenue Source. – TheRegional Government shall have thepower to create its own sources of revenues and to levy taxes, fees, andcharges, subject to the provisions of theConstitution and this Organic Act.SEC. 2. Fiscal Autonomy. – The RegionalGovernment shall enjoy fiscal autonomyin generating and budgeting its ownsources of revenue, its share of theinternal revenue taxes and block grantsand subsidies remitted to it by thecentral government or nationalgovernment or any donor.All taxing powers already devolved tothe ARMM by R.A. no. 9054 and otherlegislations shall be exercised by theBangsamoro.V. Fund Transfers from CentralGovernmentA. The central Government shallprovide a block grant to theBangsamoro. The Bangsamoro block grant shall be based on a formulaprovided in the Bangsamoro Basic Lawwhich in no case shall be less than thelast budget received by the ARMMimmediately before the establishmentof the Bangsamoro TransitionAuthority. The Basic Law shall alsoprovide a system of automaticappropriation for and regular releaseof the block grant. The Central Government shall alsoprovide for a Special DevelopmentFund to the Bangsamoro forrehabilitation and developmentpurposes upon the ratification of theBangsamoro Basic Law. The amount of the Fund that shall be proposed by theTransition Commission in the draftingof the Bangsamoro Basic Law shall berecommended by a joint needsassessment team to be created by thepanels for this purpose.C. The Bangsamoro’s annual block grant shall undergo internal budgetprocesses and shall be allocated by theBangsamoro Government in anappropriations act.D. Once the Bangsamoro attainsfinancial self-sustainability, it will alsoassist other regions in theirdevelopment efforts.IX. Auditing BodyThe Bangsamoro auditing body shallhave auditing responsibility over publicfunds utilized by the Bangsamoro. TheBangsamoro Basic Law shall providefor a clear delineation of theBangsamoro auditing body. Failure to do so shallempower the President or theSecretary of Finance to reduce,suspend, or cancel the release of fundsintended for the autonomous region tothe extent of the amounts that cannotbe audited for reasons attributable tothe officials of the autonomous regionor are unaccounted for after audit.XXXSEC. 5. Uniform, Equitable Taxation; Prohibition Against Confiscatory Taxes, Fees. – In enacting revenue-raising measures, the RegionalAssembly shall observe the principlesof uniformity and equity in taxation andshall not impose confiscatory taxes orfees of any kind. Until a regional taxcode shall have been enacted by it, theRegional Assembly may not revoke oramend, directly or indirectly, any cityor municipal ordinances imposingtaxes or fees on purely localbusinesses. Prior to the revocation oramendment of such city or municipalordinances, the Regional Assemblyshall consult with the city or municipalgovernment concerned.SEC. 6. In enacting revenue-raisingmeasures, the Bangsamoro shallobserve the principles of uniformityand equity in taxation and shall notimpose confiscatory taxes or fees of any kind.I.6. The Bangsamoro shall have thepower to establish offices for the  124 A  SIAN S TUDIES directly engaged in business in theautonomous region shall pay theircorresponding taxes, fees, and charges inthe province or city, where thecorporation, partnership, or firm is doingbusiness.Corporations, partnerships, or firmswhose central, main, or head offices arelocated outside the autonomous regionbut which are doing business within itsterritorial jurisdiction, by farming,developing, or utilizing the land, aquatic,or natural resources therein, shall pay theincome taxes corresponding to theincome realized from their businessoperations in the autonomous region tothe city, or municipality where theirbranch offices or business operations oractivities are located.SEC. 7. The Central Government shallextend assistance to the BangsamoroGovernment in the matter of taxadministration and fiscal management.This assistance shall include capacitybuilding and training programs.I.A.2. Where all taxable elements arewithin the Bangsamoro, capital gainstax, documentary stamp tax, donorsand estate tax, shall be levied by theBangsamoro and not by the nationalBureau of Internal Revenue (BIR), andthe same shall be provided in the BasicLaw.
