  1 EXTRAJUDICIAL SETTLEMENT OF ESTATE OF THE DECEASED BONIFACIO FRANCISCO WITH ABSOLUTE SALE KNOW ALL MEN BY THESE PRESENTS: This agreement made and executed by and between: THAT WE, Aniceta Santos-Francisco , widow, Ruben S. Francisco , Gerardo S. Francisco , Daisy Francisco-Ocampo , Alona Francisco-Pineda , and Lot Francisco-Soliman , all of legal age, Filipinos, all married, all residents of Estrada, Capas, Tarlac, represented herein  by Ruben S. Francisco, as per Extrajudicial Settlement of Estate of the Deceased Bonifacio Francisco with Special Power of Attorney executed on May 22, 2012 bearing Doc No. 194, Page  No. 39, Book No. 30, series of 2012 and acknowledged before Notary Public Conrado T. Danan of Guagua, Pampanga, hereinafter referred to as the VENDOR; W I T N E S S E T H: 1.   We are the sole heirs, of Bonifacio Francisco, who died on October 21, 2004 in Estrada, Capas, Tarlac; 2.   The said deceased died without a will or testament and without any debt in favor of any  person; 3.   The deceased left a parcel of land situated in Estrada, Capas, Tarlac, covered and more  particularly described as follows: TRANSFER CERTIFICATE OF TITLE NO. 319986 Registry of Deeds of Tarlac “  A parcel of land (lot 57, Psd-03-021627 (OLT) being a portion of lot B-4, Psd-23547), situated in the Bo. of Estate, Capas, Prov. of Tarlac. Bounded on the SW., along line 1-2 by lot 56, Psd-03-021627 (OLT); on the NW., along line 2-3 by Spg. Masalibusog; on the NE, along lines 3-5 by Spg Masalibusog; along line 5-6 by A-1, Psd-16873; on the SE., along lines 6-11 by lot 67 (Irrig. Canal) on the SW., along lines 11-12 by lot 58, Psd-03-021627 (OLT); along line 12413 by lot 85 (Irrig. Canal); along line 13-1 by lot 56, Psd-03-021627 (OLT).  Beginning at a point marked “1” on plan being S. 39 deg. 35’W., 1634.98 m.  from BLBM No. 1, Burot, Tarlac; Containing an area of TWENTY FOUR THOUSAND FOUR HUNDRED FOURTEEN (24,414) square meters, more or less 4.   That pursuant to Rule 74, Sec. 1 of the Revised Rules of Court of the Philippines, and  being with full capacity to contract, we do hereby adjudicate unto ourselves the land described above, in equal shares pro indiviso; 5.   That for and in consideration of the sum of FIVE HUNDRED THOUSAND PESOS (Php 500,000.00) Philippine Currency, receipt of which is hereby acknowledged by the VENDEE to their full and complete satisfaction, the VENDEE do hereby SELL, CONVEY and TRANSFER by way of ABSOLUTE SALE unto C.G. GARCIA REALTY & DEV. CORP. represented by its president, ELLER V. GARCIA, of legal age, Filipino, married, resident of Ramar Village, San Agustin, City of San Fernando, Pampanga, his heirs, assigns and successors-in-interest, all the rights, interest and  participation of the VENDEE over the above-described parcel of land.  2 IN WITNESS WHEREOF, the parties hereto have affixed their signatures on the date and at the place stated below.
