(“Top Rank”) filed a Motion for   Partial Judgment on the Pleadings Pursuant to Fed. R. Civ. P. 12(c) (“Rule 12(c) Motion”) on October 17, 2014 (Dkt. No. 46); WHEREAS, in response to Top Rank’s Rule 12(c) Motion, plaintiff Miguel Angel Garcia (“Garcia”) does not oppose and agrees to dismiss the first three causes of action in Case 2:14-cv-01456-RFB-PAL Document 52 Filed 11/04/14 Page 1 of 3    2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 his Complaint with prejudice; WHEREAS, pursuant to this joint stipulation and agreement, Top Rank agrees to withdraw its Rule 12(c) Motion and Request for Judicial Notice (Dkt. No. 47). IT IS THEREFORE AGREED, STIPULATED, AND REQUESTED by and  between the parties, by and through their respective counsel of record, that the first three causes of action in Garcia ’s  Complaint will be dismissed with prejudice. Specifically, the following three causes will be dismissed with prejudice: 1.   First Cause of Action  –   Declaratory Relief: Violation of the California Boxing Act and Professional Boxing Rules; 2.   Second Cause of Action  –   Declaratory Relief: Violation of California Labor Code Section 2855(a); and 3.   Third Cause of Action  –   Declaratory Relief: Illegal Restraint on Competition in Violation of Public Policy. Based on the parties’ stipulation to dismiss the aforementioned causes of action, Top Rank agrees to withdraw its Rule 12(c) Motion and Request for Judicial Notice filed on October 17, 2014 (Dkt. Nos. 46 and 47).
