ILLUSTRATE ALLIGATOR PIE COMPETITION CALL FOR SUBMISSIONS Dennis Lee is the author of Alligator Pie: 40 th Anniversary Edition, a board book for ages 0-5 that will feature the title poem from his classic poetry collection Alligator Pie (the Book ). HarperCollinsCanada Ltd. (the Sponsor ) is calling for submissions to the Illustrate Alligator Pie Competition (the Call for Submissions ). The chosen illustrator will be offered a Contract by the Sponsor to publish his/her illustrations in the Book (the Prize ). RULES AND REGULATIONS The Book will contain the original text of Dennis Lee s poem Alligator Pie, which is available for download from this website, together with illustrations by the chosen illustrator. The Book will be a 7.5x7.5 casebound board book, with 28 pages, or 14 two-page spreads, available for the poem text and accompanying illustrations. Text and illustrations may be on separate facing pages or incorporated together across a two-page spread. The following rules and regulations govern the submissions for and selection of the chosen illustrator, and awarding of the Prize (collectively the Rules and Regulations ). ELIGIBILITY All professional illustrators and previously unpublished illustrators who are Canadian citizens or permanent residents of Canada, and who are of the age of majority in their province or territory of residence, are eligible to win the Prize. Only one submission per illustrator. Joint submissions by collaborating illustrators are permitted if all illustrators participating in the submission are eligible. HOW TO SUBMIT Your submission ( Proposed Work ) shall consist of the following materials: As a JPEG or PDF file: One fully-rendered, full-colour illustration for either one interior page or one two-page spread. As a JPEG or PDF file(s): Detailed sketches (black & white or colour) for either two additional interior pages or two additional two-page spreads. As a Word document or PDF file: Your name, address, phone number (including area code), biography and/or C.V. (maximum of one page) and, if applicable, web site address and/or online portfolio address. You may provide notes to explain your vision for the Proposed Work (optional, maximum of 500 words). Your last name should be part of each file name. For example: Seewat_sketch1.pdf Submission files should be ed to Submissions will be accepted from 12:01am Eastern Standard Time on 23 October 2013 (the Contest Opening Date ) until 23:59 pm Eastern Standard Time on 19 December 2013 (the Contest Closing Date ). Incomplete or late entries will be disqualified. Illustrators who submit more than one submission will be disqualified. Joint submissions count as a submission by each individual illustrator. JUDGMENT Entries will be judged by a committee comprised of Dennis Lee, literary agent Hilary McMahon of Westwood Creative Artists, HarperCollins executive editor of children s books Hadley Dyer, principals and employees of HarperCollinsCanada, and children s illustration experts appointed by HarperCollinsCanada (the Judges ). When reviewing submissions, Judges will consider the unity between the illustrations and text, artistic merit, and originality. All decisions of the Judges are final in matters relating to their judging, the selection of the chosen illustrator and awarding the Prize. The Judges reserve the right to not choose an illustrator from among the entrants. Once the best Proposed Work is decided upon by the Judges, the Sponsor will notify the entrant that he/she has been chosen and will award the Prize conditional upon the completion of the Prize Conditions. PRIZE CONDITIONS Upon notification that he/she has won the Prize, as a precondition to being awarded the Prize, the chosen illustrator shall be required to enter into an agreement with the Sponsor for the development and publication of the Proposed Work in the Book on terms and in form satisfactory to the Sponsor (the Contract ). Under the terms of the Contract, the Sponsor will pay an advance and acquire all worldwide rights to publish the preliminary and finished illustrations. The chosen illustrator shall agree to revise the Proposed Work in accordance with feedback provided by the art director and editor of the Book. The Sponsor aims to publish the Book in Fall 2014, and an entrant s ability to commit to this publication schedule may be a pre-condition of awarding the Prize. As a precondition to being awarded the Prize, the chosen illustrator shall also be required to sign a Declaration and Release ( Declaration and Release ) (A) confirming compliance with the Rules and Regulations, and acceptance of the Prize as awarded; and (B) discharging and releasing the Sponsor and its respective parent, affiliates and subsidiaries, and their respective assigns, representatives and agents, including advertising, promotion and fulfillment agencies, from and against any and all liability or damages, manner of action, causes of action, suits, debts, covenants, contracts, claims and demands, including legal fees and expenses, whatsoever including but not limited to claims based on negligence, breach of contract and fundamental breach and liability for injury or property damage which the winning entrant or his/her administrators, heirs, successors or assigns might have or could have, by reason of or rising out of participation in the Call for Submissions and/or in connection with the acceptance or use of the Prize. If the entrant is unable or unwilling to enter into the Contract with the Sponsor within 30 days of the offer being made, the Prize will not be awarded to that entrant, and may be awarded to another entrant or not at all. The Prize must be accepted as awarded and cannot be transferred, assigned, or substituted except at the sole discretion of the Sponsor. Refusal to accept the Prize, to enter into the Contract or to execute and deliver the Declaration and Release shall release the Sponsor from any obligation toward the chosen illustrator. NOTIFICATION The chosen illustrator will be contacted by the Sponsor on or before 23:59 pm Eastern Standard Time on January 13, 2014 at the phone number and address set out in his/her submission. Submissions shall not be returned to the entrant for any reason. The Sponsor is not obligated to conduct any communication or correspondence with entrants except with the chosen illustrator(s). The Sponsor may, but is under no obligation to, contact entrants for the purpose of discussing the possible publication of submissions (or excerpts thereof) that were not selected for the Prize. The Prize will be awarded once the chosen illustrator has confirmed to the Sponsor that he/she meets the eligibility requirements outlined in the Rules and Regulations, has entered into an agreement with HarperCollinsCanada regarding the development of the Proposed Work, has executed and delivered the offered contract and HarperCollinsCanada and has executed and delivered to the Sponsor the appropriate Declaration and Release. GENERAL CONDITIONS Each entrant represents and warrants to the Sponsor that: the Entrant is the sole illustrator of the Proposed Work; the Entrant has the right to submit his/her Proposed Work under the Call for Submissions, and has not previously assigned, pledged or otherwise encumbered any of the rights in the Proposed Work; the Proposed Work is original, has never before been published in whole or in part in any form anywhere and does not infringe upon any copyright or upon any other proprietary or personal right; the Proposed Work contains no matter that is libelous, in violation of any right of privacy or publicity, harmful to the user or any third party so as to subject the Sponsor to liability, or otherwise contrary to law. Each entrant consents to the use of his/her name, city of residence and image on videotape and/or photograph in any publicity carried out by the Sponsor with respect to the Call for Submissions and the Prize, without further notice or compensation. Entrants acknowledge compliance with, agree to be bound by these Rules and Regulations, including eligibility requirements, and release and hold harmless the Sponsor, its respective advertising, promotional and fulfillment agencies and their respective parent, related and affiliated companies, subsidiaries, members, dealers, advertising, franchisees, promotional agencies and each of their respective directors, successors, sponsors, partners, licensees, officers, subsidiaries, agents, employees, artists, advisors, assignees, heirs, executors, legal personal representatives, and all others associated with the development and execution of the Call for Submissions, from and against any and all manner of action, causes of action, suits, debts, covenants, contracts, claims and demands, including legal and other professional fees and expenses, whatsoever, including but not limited to, claims based on negligence, breach of contract and fundamental breach and liability for physical injury, death, or property damage which the entrants or his/her administrators, heirs, legal personal representatives, successors or assigns might have or could have, by reason of or arising out of the entrant s participation in the Call for Submissions and/or in connection with the acceptance by the entrant of the Prize awarded. By entering this Call for Submissions electronically and voluntarily providing personal information, all entrants consent and agree to the Sponsor s collection and use of the entrant s information for the administration of this Call for Submissions and agree to Sponsor s use of entrant information for the purpose of contacting entrant in relation to this Call for Submissions. The Sponsor respects each entrant s right to privacy and will use personal information only to verify eligibility to participate in the Call for Submissions and to conduct the Call for Submissions. By participating in this Call for Submissions, entrants acknowledge compliance with, and agree to be bound by, these Rules and Regulations, including eligibility requirements. The Sponsor is not responsible for incorrect or inaccurate entry information which may affect a person s ability to participate in the Call for Submissions or be awarded the Prize, including but not limited to human error, technical malfunctions, lost or delayed entries for any reason, mail failures, omission, or any combination thereof, and entries which fail to fully comply with these Rules and Regulations. The Sponsor will not be responsible for lost, delayed, mutilated or misdirected Proposed Works or Declaration and Release Forms. The Sponsor reserves the right, in their sole discretion, to cancel or suspend this Call for Submissions at any time, or to amend or modify the Rules and Regulations before the Closing Date, without notice for any reason, should any cause beyond the reasonable control of the Sponsor corrupt the security or proper administration of the Call for Submissions. Any attempt to deliberately undermine the legitimate operation of this Call for Submissions is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are not in compliance with the Rules and Regulations. By participating, entrants agree that all disputes for the Call for Submissions and the Prize will be resolved in the appropriate courts in the province of Ontario in Canada, exclusively, and subject to the laws of the Province of Ontario. The Call for Submissions and the Prize is subject to all applicable federal, provincial and municipal laws.
